College Will Calculate Retirement Based On 6% Of Earnings
Your CODFA Grievance Subcommittee wants to keep you informed, to the greatest extent possible, about grievances that have been filed and their subsequent resolutions. After all, if it happened to one of us, it could happen to any of us! Please be assured that, in all cases, confidentiality will be maintained and no personal or departmental information will be revealed.
Resolved: The College will calculate earned compensation payments for faculty who have submitted their retirement letters based on 6% of earnings, rather than base salary (10-06)
The grievance arose after the initial group of faculty retiring under the SURS 6% rule received an earned compensation payment based on 6% of their base salary as opposed to 6% of their earnings, as specified by the contract. The parties then engaged in several written and oral consultations with SURS, primarily centered around avoiding a penalty to the College from SURS for overpayment, again as specified by the contract.
The grievance was resolved with the College's written agreement to calculate earned compensation payments based on 6% of earnings, in accordance with the written advice received from SURS. The College further agreed to inform SURS that the higher amount should be retroactively applied to the 08-09 AY, again in accordance with SURS' stated policies. The parties agreed that should SURS somehow decide to impose a penalty on the College regardless, then alternative solutions will be explored.
