Reassigned Administrator Is A Faculty Member

Your CODFA Grievance Subcommittee wants to keep you informed, to the greatest extent possible, about grievances that have been filed and their subsequent resolutions. After all, if it happened to one of us, it could happen to any of us! Please be assured that, in all cases, confidentiality will be maintained and no personal or departmental information will be revealed.

Resolved: If It Walks Like A Duck…A Former Administrator Reassigned To A Faculty Position Is, In Fact, A Faculty Member (09-01)

Grievance 09-01 was filed by the Association on behalf of all faculty members after it was discovered that an administrator who had been reassigned to a full-time faculty position and had been performing all the duties expected of that position was experiencing discrepancies concerning dues withholding, leave and other pay-related issues.

The administration initially claimed that because of certain paperwork issues, the individual was still an administrator but was assigned to "faculty-type classroom duty." However, the Association prevailed in arguing that this position does not exist, and that someone is either an administrator or a faculty member, but not both.

The grievance was resolved with a written agreement that the individual was, indeed, a faculty member and fully subject to the rights and protections of the 2007-2011 Contractual Agreement.
