Failure To Fairly Process An E-Range Request

Granted: The Administrative Failure To Fairly Process An E-Range Request Was Overturned (08-01)
Grievance 08-01 was filed when a Faculty Member (FM) was denied movement from D-to-E due to an issue surrounding an alleged insufficient number of credits. The FM had fulfilled all the components of the E-Range Plan and had submitted the application in a timely manner; however, a discrepancy arose concerning an "R" grade for a Physical Education course the FM had taken in 2005. The FM then sought to resolve the issue in accordance with the course of action taken previously by the Dean for an identically-situated FM.
The administration initially refused this attempt at resolution, and the FM's application for E-Range was denied. Subsequent discussions with the administration proved fruitless, and the Administration's resulting failure to process the FM's application gave rise to this grievance.
During the grievance, which was granted at Step One, the administration acknowledged that the FM had completed all requirements for the E-Range Plan, had submitted the application on time, was deserving of placement onto E-Range, and had attempted to resolve the credit hour dispute in a timely manner as soon as the FM became aware of it. The administration also acknowledged that refusing to resolve the dispute in the same manner as had been afforded an identically-situated employee would be arbitrary and capricious. The FM was awarded E-Range with full back pay, retroactive to the start of the 08-09 AY.
It is important to note that it is the FM's responsibility to submit credits earned toward range changes to Human Resources in a timely manner and to ensure that HR records the correct number of hours for credits earned. Please also note that, under current HR policies, "R" grades are not applicable toward range changes. Any disputes about earned credits should be resolved at the time they are submitted to HR.
